The Fair Fund is a distribution fund created by the United States District Court for the Northern District of Texas in the civil action filed by the Securities and Exchange Commission (the “SEC”), SEC v. United Development Funding III, LP. et al., 3:18-CV-01735-L (N.D. The Fair Fund will be distributed pursuant to a distribution plan approved by the Court, available for reviewing and downloading on the Important Documents tab on this website. 

Investors who, during the period from January 1, 2011 through December 31, 2015, inclusive, held limited partnership interests in United Development Funding IV and/or purchased the common stock of UDF IV that was traded on the Nasdaq Global Select Market under the symbol UDFI. 

No, only investors in United Development Funding IV, as further described in the prior FAQ, are eligible for a distribution from the Fair Fund.

There is no claims process in this matter.  However, if you receive a Notice of Fair Fund and Deadline to Submit the Additional Information Request Form and Additional Information Request Form (the “Notice”), you must timely complete and submit the Additional Information Request Form accompanying the Notice, all documentation requested on Additional Information Request Form, and the tax form requested on the bottom of page 2 of the Notice, so that we can accurately determine your eligibility for a distribution.

You received a postcard because you have been identified as an individual or entity, or their lawful successor who, during the period from January 1, 2011 through December 31, 2015, inclusive, held limited partnership interest(s) in United Development Funding IV and/or purchased common stock of United Development Funding IV that was tracked on the Nasdaq Global Select Market under UDFI.  You do not need to respond to the Postcard Notice; we do not need any additional information from you at this time.

You received the Notice of Fair Fund and Deadline to Submit the Additional Information Request Form (“Notice”) and Additional Information Request Form because we need additional information from you to determine your eligibility to receive a distribution from the Fair Fund.  Please timely complete and submit the Additional Information Request Form accompanying the Notice, all documentation requested on Additional Information Request Form, and the tax form requested on the bottom of page 2 of the Notice, so that we can accurately determine your eligibility for a distribution.

If you received a Notice of Fair Fund and Deadline to Submit the Additional Information Request Form (“Notice”) and Additional Information Request Form, please complete and submit the Additional Information Request Form, all documentation requested on Additional Information Request Form, and the tax form requested on the bottom of page 2 of the Notice, either electronically through our secure portal at https://udffairfund.com/secure-portal/ no later than 11:59 p.m. EST on January 17, 2022 or by mail postmarked no later than January 17, 2022 to: UDF Fair Fund, c/o Strategic Claims Services, 600 N. Jackson Street, Suite 205, P.O. Box 230, Media, PA 19063.

If you received a Postcard Notice, the Distribution Agent has the information necessary from the claim filed in the related action (In re United Development Funding IV Securities Litigation, Master File Case No. 3:15-cv-04030-M (N.D. Tex.)) and the records obtained by the SEC from the defendants and others to determine if you are eligible for a distribution of the UDF Fair Fund.  Nothing further is needed from you at this time.  If you are determined to be eligible for a distribution under the Court-approved distribution plan, a distribution payment will be sent to you without further action by you.
